The job is closing. The machine has gone back to the yard. Then a new line shows up on the off hire report or the final invoice: damage charge.
It is a frustrating moment, especially when nobody on site remembers anything going wrong.
We run a rental desk in Dubai, so we raise these charges and we settle them. That means we see both sides of the conversation. This guide explains, honestly, how a damage charge at off hire in Dubai should be checked, questioned and resolved, without turning it into a fight.
If a damage charge appears at off hire in Dubai, do not pay blind or ignore it. Reply in writing, check your hire agreement, and ask the rental company for dispatch photos, collection photos, the off hire inspection report and an itemised repair quote. Compare them with your own site photos, then agree the charge or request a joint inspection.
1. Why Do Damage Charges Show Up at Off Hire?
Off hire is usually the first time the rental company sees the machine since delivery. So it is the point where damage gets found and written down.
On Dubai jobs, the items we regularly see include:
- Platform cages that have touched soffits, ceilings or beams.
- Tyres or tracks cut on rebar, kerbs and site debris.
- Outriggers dragged instead of lifted.
- Torn decals, covers and safety labels.
- Snagged hydraulic hoses.
- Batteries left completely flat.
- Dust, sand and cement slurry caked into moving parts.
Basement car parks, tight marble lobbies and tower podiums all add their own knocks.
Here is the part worth saying clearly. Most hirers never damage a machine on purpose. A busy site is a busy site. A damage charge is not an accusation. It is a record of what was found, and it should come with proof.
Is the charge raised at collection or after the machine reaches the yard?
There are two common patterns.
Sometimes the driver notes damage on the collection note while still on site. Other times the damage is found during the yard inspection after transport.
The second pattern causes more disputes, because nobody from the hirer’s side was there to see it. A fair company tells you quickly and sends photos.
How quickly depends on the contract. One UK access hire firm, for example, states it will notify damage within 5 working days. Terms differ between companies, so check what your own agreement says.
2. A Typical Off Hire Damage Call at Our Rental Desk
A fit out contractor finishing ceiling works in a Business Bay office tower called our desk the morning after we collected an articulated boom lift.
The project manager was surprised. Our driver had noted a bent mid rail on the platform cage at collection, and the site supervisor had signed the collection note. But the supervisor had signed it quickly, without really looking, and nobody had passed the message upstairs.
So the first the project manager heard of it was our call.
We did what we always try to do. We sent the dispatch photos and the collection photos side by side. In the dispatch set, the rail was straight. In the collection set, it was clearly bent inward.
Then we explained why it mattered. A mid rail is part of the fall protection on the platform. It is a safety part, so it has to be replaced before that machine goes out on the next hire. It is not something you can call wear and tear. Rails do not bend from normal use.
We shared the breakdown: the part, the labour, and the time in the workshop. And we offered a call with the supervisor so everyone was looking at the same pictures.
The project manager went back to his ceiling subcontractor. It turned out the cage had been used to push a ceiling panel up into place. Not malicious, just a shortcut on a long day.
The charge went through on the normal invoice. No drama, no raised voices.
The lesson for us was the same one we see again and again. Evidence on both sides turned it into a ten minute conversation instead of a two week argument. If you need this kind of machine for ceiling work, our boom lift rental in Dubai page covers the options.
3. Damage or Fair Wear and Tear: Where Is the Line?
Most hire terms follow one simple principle. You return the equipment in the same good order you received it, fair wear and tear excepted.
That exact wording appears in the UK industry’s CPA Model Conditions for the Hiring of Plant. It is UK practice, not UAE law, but many UAE hire terms work on the same idea.
In plain words:
- Wear and tear is slow deterioration from normal, correct use.
- Damage is a sudden event, an impact, or misuse.
Here is how that looks on real machines.
Access platforms (boom lifts, scissor lifts, spider lifts, man lifts)
Wear and tear: light scuffs on the chassis, normal tyre wear, faded paint.
Damage: bent guardrails or toe boards, a cracked control box cover, a crushed platform extension, tyres torn by debris, impact marks on the jib or boom, and chemical marks on non marking tyres. Tilt or overload alarm events can also point to misuse.
This applies whether you have a scissor lift rental on a warehouse floor or spider lifts for marble lobbies and indoor work.
Telehandlers and boom loaders
Wear and tear: fork tips worn evenly, normal tyre wear.
Damage: bent forks or carriage, cracked mirrors, broken lights, side impact on the boom, a broken windscreen. Our boom loader rental machines are inspected for exactly these points.
Mini excavators, backhoe loaders and skid steers
Wear and tear: bucket teeth worn within normal limits, gradual track wear.
Damage: snapped teeth or adapters, tracks cut or thrown through misuse, a dented cab, broken glass, damaged hydraulic rams.
Many terms treat ground engaging parts such as teeth and blades as the hirer’s cost. That sits closer to consumables than damage, and we cover it in what to do when fuel and consumable charges are disputed in Dubai. It applies to mini excavator rental and JCB 3CX backhoe loader rental alike, along with Bobcat skid steers.
Generators and forklifts
For generator rental, damage usually means dents to the canopy or damaged cables and sockets. For forklift rental, look at the mast, the forks, and batteries damaged by deep discharge.
What about cleaning?
Cement slurry, paint overspray, epoxy and heavy sand are everyday hazards on Dubai fit out and facade jobs.
Under many hire terms, cleaning beyond normal dust is chargeable. But it is a cleaning charge, not damage. It should be shown as a separate line, so you can see exactly what you are paying for.
4. What Should You Do First When You See the Charge?
Stay calm and work through it in order.
Step 1: Do not ignore it, and do not pay blind
Reply in writing within a day or two. Say you have received the charge and you are reviewing it.
That is all you need at this stage. Many terms set short windows to query an invoice. Some UK hire terms allow 10 working days, others 14 days from invoice date. Moving quickly protects your position.
Step 2: Read your hire agreement and delivery note
Find the clauses on condition at delivery, damage, wear and tear and cleaning.
Also check how fast you had to report defects after delivery. UAE terms commonly set a short window, often 48 hours. If you reported a mark within that window, that record matters now.
Step 3: Ask for the evidence pack
Request these documents before you agree to anything:
- Dispatch or on hire photos.
- The signed delivery note.
- Collection photos with date and time.
- The off hire or return inspection report.
- An itemised repair quote showing parts, labour hours and rate.
- Whether hire will be charged while the machine is being repaired.
Step 4: Gather your own evidence
Pull together your site photos and the daily pre use inspection checklists your operator completed.
Add any defect reports you raised during the hire, your WhatsApp messages with the rental desk, and the name of the person who signed the collection note.
Step 5: Compare, then talk
Put both sets of photos side by side.
If the damage is clear, keep the conversation to price and timing. If it is not clear, ask for a joint inspection at the yard before the repair starts. For a significant amount, ask for an independent assessor or a second workshop quote.
Step 6: Agree the outcome in writing
The result will be one of three things: the charge stays on the invoice, a revised invoice is issued, or a tax credit note reduces or cancels the charge.
Keep the full email trail. Your accounts team will thank you.
If it helps, a short message like this works well:
We have received the damage charge on the off hire for the boom lift collected from our site. Before we process it, please send the dispatch photos, the collection photos with date and time, the return inspection report and an itemised repair quote. We would also like to know if hire will continue during the repair. We will review and come back to you promptly.
It is polite, specific, and leaves room for an easy outcome.
5. What Evidence Should a Fair Rental Company Give You?
You are entitled to expect proof. This is the standard we work to on our own fleet, and the standard you can reasonably ask of anyone:
- The condition of the machine at dispatch, backed by photos and the inspection log kept for that unit.
- A current test certificate and up to date maintenance records.
- Time stamped collection photos.
- A written description of each item of damage and where it is on the machine.
- A parts and labour breakdown.
- A willingness to let you see the machine before it is repaired.
Our view is simple: if we cannot show it, we should not charge it.
Why time stamps and original files matter
Original photo files keep their date, time and often their GPS location. Screenshots, edited images and heavily compressed chat images can lose that data.
So keep the originals from your phone. When evidence matters, send the files themselves rather than forwarding a compressed image in a chat. And ask the rental company to do the same.
6. Should You Pay a Disputed Damage Charge or Hold Payment?
There are a few sensible options:
- Pay the undisputed part of the invoice and query only the damage line.
- Agree to pay the damage line after a joint inspection.
- Hold only the disputed line while it is resolved.
Be careful with withholding the whole invoice. Many hire terms say you cannot hold back payment of the entire invoice because one line is in dispute.
Withholding everything can also affect your credit terms, your statement of account, and how future bookings are handled, with any supplier.
This is general guidance, not legal advice. Check your own hire agreement and take professional advice for large or complex claims.
What about VAT on the damage charge?
Damage charges billed by a VAT registered UAE company carry VAT at the standard rate of 5 percent, shown on a tax invoice with the supplier’s TRN. The UAE Ministry of Finance confirms this rate has applied since 1 January 2018.
If a charge is reduced or cancelled after the invoice is issued, the correct fix is a tax credit note, not deleting the invoice. Loop your accounts team in early so the records line up with Federal Tax Authority rules.
7. Who Pays if a Subcontractor Damaged the Machine?
The rental contract is normally between the rental company and whoever hired the machine. Usually that is the main contractor.
So in most cases, the hirer answers to the rental company first. Then the hirer recovers the cost from the subcontractor under their own subcontract, often as a back charge.
That is exactly what happened in our Business Bay story. The project manager settled with us, then dealt with his ceiling subcontractor separately.
A few habits make this far easier:
- Record who used the machine each day.
- Ask subcontractors to sign the machine handover and the daily pre use checks.
- Allow only trained operators on access platforms, ideally IPAF trained.
When the record is clear, passing the cost on is a short conversation.
8. Does Hire Keep Running While the Machine Is Repaired?
Terms vary a lot here.
Some companies stop hire at collection and charge only for the repair. Others state that hire charges continue until repairs and cleaning are complete, as some UK hire terms do. That second approach is sometimes described as loss of use.
The difference can be significant, so ask the question up front, ideally before you hire. If you are hiring from us, just ask our desk and we will explain how it applies to your machine and your agreement.
If the charge you are looking at includes extra hire days, our guide on what to do when you are billed for idle standby days in Dubai may also help.
9. What If You Cannot Agree?
Most disputes end at the first or second step. If yours does not, escalate calmly:
- Manager level review. Ask for a senior person at the rental company to review it, along with a joint inspection.
- Independent assessor. Agree on an independent assessor or a third party workshop quote.
- Department of Economy and Tourism. Dubai’s Business Protection Department handles business to business complaints against DET licensed businesses, through consumerrights.ae or the Dubai Consumer app. Some sectors are excluded and a fee applies. The UAE Government portal explains the route.
- Dubai Courts Centre for Amicable Settlement of Disputes. This centre handles many claims below AED 500,000 before they reach litigation.
UAE civil law has also been updated recently, so it is worth checking your contract’s governing law and dispute clause with an adviser.
This is general guidance, not legal advice. Check your own hire agreement and take professional advice for large or complex claims.
10. How Can You Avoid Damage Charges Next Time?
Prevention is mostly about photos and habits. Ten minutes at delivery and ten minutes at collection can save weeks later.
On hire checklist (at delivery)
- Walk around the machine with the driver.
- Photograph all four sides and all four corners.
- Photograph the platform or cab, the control box, tyres or tracks, outriggers, the hour meter, and the battery charge or fuel level.
- Photograph decals and safety labels.
- Check the test certificate and machine documents.
- Note any marks on the delivery note before you sign.
- Report defects in writing within the window in your terms.
During the hire
- Complete the daily pre use inspection.
- Use trained operators only. IPAF training for your operators cuts down on the misuse that causes most platform damage.
- Report any incident or defect straight away, in writing.
- Do not repair the machine yourself.
- Protect the machine from paint, cement and epoxy.
- Secure the machine overnight.
Off hire checklist (at collection)
- Call off hire in writing and get confirmation back.
- Have a named person present at collection.
- Take the same photo set as at delivery.
- Clean off heavy site dirt.
- Check accessories: charger, keys, harness anchor points, outrigger pads.
- Read the collection note before signing. If you are rushed, write “subject to inspection”.
The supervisor in our story would have caught the bent rail on the spot by doing just that last step.
11. How Dream Way Handles Damage at Off Hire
We would rather spend five minutes explaining a charge than lose a customer over one.
Every machine is checked before it leaves our yard in Ras Al Khor Industrial Area 2. We keep test certificates, inspection logs and maintenance records current for each unit, so the condition of a machine at dispatch is on record, not just in someone’s memory.
During the hire, our support line runs 24/7. If a unit has a problem on site, we arrange support or a machine swap, so a fault does not turn into a bigger issue.
When we do find damage at off hire, we explain it with evidence. You see what we saw, you get the breakdown, and you can ask us anything about it. If you hire a man lift with free delivery and collection in Dubai, that collection is the moment the off hire process starts, and we are happy to walk you through it before your first booking.
You can see the full range of our rental services, delivered across all seven Emirates.
12. Frequently Asked Questions
Can a rental company charge for damage after the equipment has been collected?
Yes, many hire terms allow it, because damage is often found during the yard inspection after transport. A fair company should tell you quickly and send time stamped collection photos, the inspection report and an itemised quote. Check your agreement for any notification window, and ask to see the machine before repair if you are unsure.
What counts as fair wear and tear on rented equipment?
Fair wear and tear is gradual deterioration from normal, correct use, such as light scuffs, faded paint, normal tyre wear or evenly worn fork tips. Bent guardrails, cracked covers, torn tyres, broken glass and impact marks are damage, because they come from a sudden event or misuse.
What documents should I ask for before paying a damage charge?
Ask for dispatch or on hire photos, the signed delivery note, collection photos with date and time, the off hire inspection report, and an itemised repair quote showing parts, labour hours and rate. Also ask whether hire continues during the repair. Compare everything with your own site photos.
Do I pay VAT on equipment damage charges in the UAE?
Yes. Damage charges from a VAT registered UAE company carry VAT at the standard 5 percent rate on a tax invoice. If the charge is later reduced or withdrawn, it should be corrected with a tax credit note. Confirm the treatment with your accountant.
Who pays if my subcontractor damaged the hired machine?
Usually the company that hired the machine pays the rental company, because the contract is between them. That company then recovers the cost from the subcontractor under its own subcontract. Clear daily records of who used the machine make this much easier.
Can I hold payment of the whole invoice because of a damage dispute?
Many hire terms say you cannot withhold the full invoice over one disputed line. A safer approach is to pay the undisputed part and query only the damage line in writing. This is general guidance, not legal advice, so check your own agreement.
How quickly should I report damage or defects found at delivery?
As soon as you find them, in writing. Many UAE terms set a short window, commonly 48 hours from delivery, after which the machine is treated as delivered in good order. Note any marks on the delivery note before signing and photograph them.
Where can a business in Dubai complain about another business?
Dubai’s Department of Economy and Tourism has a Business Protection Department that handles business to business complaints against DET licensed businesses, through consumerrights.ae or the Dubai Consumer app. Some sectors are excluded and a fee applies. For larger claims, take legal advice.
